By purchasing, accepting, holding, using, or attempting to use a ticket for SantaCon 2026 (the “Event”), the purchaser and/or attendee agrees to the following Terms and Conditions, Waiver, and Release of Liability Agreement.
This agreement is entered into by and between Almost Nakey LLC (“Organizer”) and the ticket purchaser, ticket holder, guest, attendee, and/or participant, collectively referred to as “Guest,” “Ticket Holder,” “you,” or “your.”
The Event may include music, entertainment, food and beverage areas, bars, vendor areas, interactive experiences, games, activities, performances, crowds, and other related facilities, programming, activities, or amenities.
By completing a ticket purchase, entering the Event, or participating in any Event activity, you acknowledge that you have read, understood, and agreed to be bound by these terms.
1. Acceptance of Terms
By purchasing, accepting, holding, using, or attempting to use a ticket, you agree to these terms established by Almost Nakey LLC, the Event venue, and the other Released Parties identified in this agreement.
If you do not agree to these terms, do not purchase a ticket, enter the Event, or participate in Event activities.
2. All Sales Final
All ticket sales are final. No refunds, exchanges, cancellations, or credits will be granted for any reason, including but not limited to personal conflicts, illness, injury, weather, travel issues, dissatisfaction, mistake, failure to attend, or failure to meet entry requirements.
Tickets are non-transferable unless otherwise stated by Organizer or permitted through the official ticketing platform.
3. Event Changes, Cancellation, and Force Majeure
Organizer reserves the right to change the lineup, schedule, programming, venue, Event layout, capacity, amenities, activities, vendors, partners, or any other aspect of the Event at any time without issuing refunds.
If the Event is canceled and not rescheduled, Organizer may offer refunds, credits, or other remedies at its sole discretion, except where otherwise required by law.
No refunds will be issued for cancellations, delays, interruptions, or changes caused by events outside Organizer’s reasonable control, including but not limited to natural disasters, weather, fire, flood, earthquake, public health restrictions, government action, labor disruptions, acts of God, terrorism, civil unrest, power failure, venue closure, performer cancellation, or other force majeure events.
4. Entry and Conduct
A valid ticket does not guarantee entry. Entry is subject to venue policies, security screening, age requirements, capacity limits, health and safety rules, and all applicable laws and regulations.
Organizer, venue staff, security, and their representatives reserve the right to deny entry or remove any Guest without refund for any reason deemed necessary, including but not limited to intoxication, disorderly conduct, unsafe behavior, failure to comply with staff instructions, possession of prohibited items, violation of venue rules, harassment, threats, violence, or conduct that may negatively affect the safety or experience of others.
Guests are responsible for their own behavior and for any damage they cause to the venue, facilities, equipment, amenities, or property.
5. Assumption of Risk
Guest acknowledges and agrees that attending a live Event involves inherent risks.
Risks may include, but are not limited to:
- Personal injury, illness, death, or property damage
- Slips, trips, falls, or collisions
- Crowded environments and contact with other attendees
- Loud music, flashing lights, special effects, and amplified sound
- Weather, sun exposure, heat, cold, or dehydration
- Participation in games, activities, performances, or interactive experiences
- Food or beverage-related illness or allergic reactions
- Alcohol consumption or the conduct of intoxicated individuals
- Acts or omissions of other attendees or third parties
- Theft, loss, or damage to personal property
- Transportation-related risks associated with traveling to or from the Event
- Other hazards associated with live events, crowds, entertainment, venue conditions, or participation in Event activities
Guest voluntarily assumes full responsibility for any and all risks of harm, injury, illness, death, or property damage arising out of or related to attendance at the Event or participation in Event activities, even if caused in whole or in part by the negligence of the Released Parties, to the fullest extent permitted by law.
Guest represents that they are physically and medically able to safely participate in any activities they choose to participate in. Guest is solely responsible for determining whether participation is appropriate based on their health, medical history, medications, physical condition, level of intoxication, and personal circumstances.
6. Waiver and Release of Liability
To the fullest extent permitted by law, Guest voluntarily releases, waives, and discharges Almost Nakey LLC, the Event venue, property owners, sponsors, partners, vendors, contractors, performers, production companies, and each of their respective owners, officers, managers, attorneys, members, directors, successors, assigns, employees, agents, contractors, representatives, affiliates, and related parties, collectively referred to as the “Released Parties,” from any and all claims, demands, actions, causes of action, damages, liabilities, losses, costs, and expenses arising out of or related to:
- Guest’s attendance at the Event
- Guest’s participation in any Event activity
- Personal injury, illness, death, or property damage
- Theft, loss, or damage to personal belongings
- Acts or omissions of other attendees or third parties
- The negligence of any Released Party, to the fullest extent permitted by law
This release applies to all claims, whether known or unknown, foreseen or unforeseen, and includes claims for personal injury, illness, death, property damage, and economic loss.
Guest understands and acknowledges the significance and consequences of this waiver and voluntarily agrees to assume all risks associated with attending the Event and participating in Event activities.
7. Indemnification
Guest agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, actions, damages, liabilities, losses, costs, and expenses, including reasonable attorneys’ fees, arising out of or related to:
- Guest’s attendance at the Event
- Guest’s participation in Event activities
- Guest’s acts or omissions, whether negligent or otherwise
- Any injury, illness, death, or property damage allegedly caused by Guest
- Claims brought by third parties in connection with Guest’s attendance, conduct, or participation
- Guest’s breach of this agreement
Guest acknowledges and agrees that this indemnification obligation shall survive the Event and shall continue to apply after the Event has ended.
8. Damage to Venue or Property
If Guest damages any portion of the venue, facilities, equipment, amenities, or property, Guest agrees to be responsible for the cost of repair, replacement, cleaning, or other remedy.
Upon notice of a statement or invoice from Organizer, the venue, property owner, or their agent, Guest agrees to remit payment for such damage.
9. Health and Safety
Guest agrees to follow all posted and communicated health, safety, security, and venue rules.
Guest should not participate in any activity if they are ill, injured, excessively intoxicated, under the influence of substances that impair their ability to participate safely, have a medical condition that may be aggravated by participation, or have been advised by a medical professional not to participate.
Guest is solely responsible for stopping participation if they feel unwell, dizzy, faint, overheated, short of breath, in pain, disoriented, or otherwise unsafe.
10. Alcohol and Intoxication
Guest acknowledges that alcoholic beverages may be available at the Event.
Guest is solely responsible for their own alcohol consumption and behavior. Organizer and the Released Parties reserve the right to refuse alcohol service, deny entry, or remove any individual who appears intoxicated, impaired, disruptive, or unsafe.
Guests may not provide alcohol to anyone under the legal drinking age.
Guest accepts all risks associated with alcohol consumption and agrees not to operate a motor vehicle while impaired.
11. Personal Property
Guest is solely responsible for their personal property. Organizer, the venue, and Released Parties are not responsible for lost, stolen, damaged, or misplaced items.
12. Chargebacks and Payment Disputes
Guest agrees not to initiate a chargeback or payment dispute for any valid ticket purchase or Event-related charge that is subject to these terms.
Before initiating any payment dispute, Guest agrees to contact the official ticketing support channel or Organizer to attempt to resolve the issue.
Unauthorized or improper chargebacks may result in cancellation of tickets, denial of entry, collection efforts, legal action, and/or banning from future Almost Nakey events, to the fullest extent permitted by law.
Nothing in this section limits any rights that cannot legally be waived.
13. Media Consent
Guest acknowledges that photography, video recording, audio recording, livestreaming, and other media capture may occur at SantaCon 2026.
By entering the Event, Guest grants Almost Nakey LLC, the Event venue, sponsors, partners, media teams, photographers, videographers, and their authorized representatives the right to photograph, film, record, and otherwise capture Guest’s name, image, likeness, voice, appearance, and participation at the Event.
Guest grants permission for such media to be used, edited, reproduced, displayed, distributed, published, and shared for promotional, marketing, advertising, social media, archival, editorial, and commercial purposes without additional notice, approval, or compensation.
14. Compliance with Laws and Venue Rules
Guest agrees to comply with all applicable federal, state, and local laws, rules, regulations, and ordinances, as well as all venue and Event policies.
Any violation of applicable law or venue policy may result in denial of entry, removal from the Event, cancellation of tickets, and/or referral to law enforcement, without refund.
15. Severability
If any provision of this agreement is found to be invalid, unlawful, or unenforceable, the remaining provisions shall remain in full force and effect.
16. Binding Agreement
Guest acknowledges that this agreement is intended to be as broad and inclusive as permitted by law.
By purchasing, accepting, holding, using, or attempting to use a ticket for SantaCon 2026, Guest confirms that they have read this agreement, understand its terms, understand that they are giving up substantial legal rights, and agree to be legally bound by it.
